Deliveries are carried out exclusively to retailers, there are no deliveries to end-consumers.
1. The DELIVERY shall take place on cash-on-delivery including payment of packaging-, shipping- and cash-on-delivery expenses. If a valid direct-debit-authorization is present, the order is send via mail, railway or forwarding agency DDU (Delivered Duty Unpaid) for a flat rate of Euro 6,70. We are entitled to change this flat-rate in the event of changing rates of the forwarding agent. We select and deliver the cheapest shipment method according to the necessary requirements. Additional costs, which emerge through customer’s wishes for different delivery or forwarding agency, will be charged separately. The goods are forwarded at customer’s risk from the moment they are handed over to the forwarding agent. The forwarding agent is liable for any damages and these have to be claimed immediately when goods are being received.
2. Any COMPLAINS regarding the conditions of the goods can only be accredited, if these are received in written form within 8 days after delivery. Defects which are not recognizable immediately have to be notified in writing immediately upon discovery.
3. Placed orders cannot be cancelled and ordered items shall not be returned. We can refuse to take back items or credit the price of the item from the day ordered minus 20% processing charges. RETURNED ITEMS will only be taken back FREE-DELIVERY and after previous consultation with one of our employees – otherwise items will not be accepted. In case of a legitimate complaint, the freight and transportation costs will be reimbursed. We might cancel an order, should we be informed of a possible insolvency of the party having placed the order.
4. The pricing of the order is subject to the prices given on the day of ordering plus VAT. We reserve the right to adjust accepted prices without prior notice.
5. If items are not available at point of ordering, they are kept at backorder for 4 weeks starting the day of ordering and will be delivered at a later stage during these 4 weeks. Should subsequent delivery be unwanted, this has to be specifically expressed during order taking.
6. Time for delivery is stated as accurately as possible but is not guaranteed and is subject to extension to cover delays caused by events beyond our control. Damage claims as well as delay expenses in the event of a delay in delivery cannot be asserted.
7. TERMS OF PAYMENT if not agreed on differently: At the existence of a direct-debit-authorization NET, within 10 days from the invoice date or via cash-on-delivery. All expenses, accrued through rejection of a debit, as for example with uncovered bank accounts, changes in bank accounts or uncalled-for cancelation of debit, will be invoiced. This also accounts for expenses for non-acceptance of subsequent deliveries. If the date of payment is expired, we are entitled to invoice interest for delay. If a debit, for whatever reason, is being rejected, the following orders will only be made by cash-on-delivery.
8. MARK-UP FOR SMALL VOLUME ORDERS: The order value per order should not be less than Euro 20,- excl. VAT, otherwise a mark-up for small volume orders of Euro 3.50,- will be added.
9. UNTIL FULL PAYMENT, INCLUDING ANY POTENTIAL COLLATERAL CHARGES, HAS BEEN RECEIVED BY SCHUMOTO, THE GOODS SHALL REMAIN PROPERTY OF SCHUMOTO. All payments have to be made immediately. Our salesmen are not authorized to accept payment. Both, jurisdiction and place of fulfillment is Linz.
10. All terms and conditions contained in prior written and especially oral communications with our employees, require our written approval.
